Following the creation of flexible working arrangements for International Medical Graduates (IMGs) under the subclass 457 visa, the subclass 422 visa will no longer be available for new primary visa applicants from 1 July 2010. DIAC has announced a new Skilled Occupation List (SOL) for General Skilled Migration (GSM). The new SOL does apply for non-GSM visas, such as ENS, RSMS or Subclass 457.

The Minister for Immigration and Citizenship, Senator Chris Evans, said on Tuesday 11th May 2010. The Government will sharpen the focus of the skilled migration program on areas of skills shortage but will maintain the current overall size of the migration program. The overall size of the migration program will remain unchanged with a total of 168 700 places, comprising a total skill stream of 113 850 places, a total family stream of 54 550 places and 300 special eligibility places.

The Minister has announced on 7 May 2010 a temporary suspension of certain general skilled migration visas. The Minister has not indicated when the suspension will be lifted, however it will be no earlier than the announcement of the new Skilled Occupation List (SOL).

Regarding partner visa applications, section 48 of the Migration Act is where an applicant is ineligible to apply for any further visas onshore if they have been refused or had a visa cancelled onshore.
